This is the Privacy Policy of TimeMaker LLC, a Florida limited liability company. 
 
PERSONAL INFORMATION
TimeMaker understands your desire to protect personal information such as your name, address, email address, age and other personally identifiable information (your “personal information”). In this policy, we inform you how your personal information will be gathered, tracked and used, how you can opt out of certain communications, and how to contact our company regarding any of our policies. 
 
What Information We Gather and Track
We request personal information when you place an order, register your software, request a service, answer a survey, enter a contest, correspond with us or engage in certain other activities on our Web site. For example:
 
a. If you submit an order online with us, we will ask you for information necessary to complete the transaction - such as your name, mailing address and e-mail address. Credit card numbers for online transactions are stored by third party service providers such as Paypal.
 
b. If you request technical support online, we will ask you for information necessary to complete the transaction - such as your name, TimeMaker database information and information about your computer hardware, software and the nature of the problem you are experiencing.
 
You make the decision whether to proceed with any activity that requests personal information. If you do not wish to provide the requested information, you may not be able to complete the transaction.
 
How We Use the Information We Gather and Track
We use personally identifiable information in the following ways:
 
a. To allow you to purchase and download products, obtain access to services or otherwise engage in activities you select.
 
b. To send confirmation e-mails verifying the ownership of the e-mail addresses provided in your account information.
 
c. To establish your TimeMaker account;
 
d. To help you resolve any difficulty you may experience in using our software products and to otherwise provide requested services in regard to issues relating to your account.
 
e. To enable your access to our support system;
 
f. To assist us in creating content that is relevant to you and to improve your experience on our Web site;
 
g. To assist us in creating better products and services to meet your needs;
 
h. We may send customers periodic emails containing information about TimeMaker software and other TimeMaker products, software upgrades, new products and services, new software features, software usage tips, newsletters, informative emails, and customer satisfaction questions and surveys on future product ideas or improvements; and
 
i. If you are using TimeMaker pursuant to a free trial offer, on occasion we may provide you with special third party offers that may be of interest to you.
 
On rare occasions it is necessary to send out an administrative notice concerning your account which is not promotional in nature. This announcement may notify you of changes to the Privacy Policy and/or terms of service, as well as planned service suspensions and outages. Generally, you may not opt-out of these communications, though you can deactivate your account. These notifications will generally be sent to a validated e-mail address for your account.
 
TimeMaker may also access your personal information for the following administrative purposes: (a) to examine system accounting logs, user accounts and other company records to resolve security, email and other system errors or problems; (b) for billing purposes; and (c) to ensure that only paid subscribers are able to access certain subscriber-only services. 
 
With Whom We May Share Your Personal Information
If you are a TimeMaker subscriber or have paid for the use of TimeMaker Software, TimeMaker will not sell your personally identifiable information.
 
If you are a TimeMaker subscriber or have paid for the use of TimeMaker Software, except in regard to utilization of outside service providers set forth below, TimeMaker will not share any of your personally identifiable information with any outside party without your explicit consent unless we are required to by law or where necessary to cooperate with law enforcement agencies or comply with a legal process served on our Web site. You hereby authorize TimeMaker to disclose your personal information where, in TimeMaker’s discretion, disclosure is required or appropriate as outlined above.
 
TimeMaker retains the services of outside contractors to provide services for us. They may be used to ship products, provide technical support, or handle order processing. We require that these contractors keep the personal information of customers secure and confidential. We also require that these contractors use personal information only on behalf of TimeMaker. 
 
We may from time to time share aggregated and anonymous demographic information with our business partners but no such information can be linked directly to your personally identifiable information.
 
If you are using TimeMaker pursuant to a free trial offer, from time to time, we may provide your information to selected business partners to communicate to you information about products or services that they believe are important to you or your business. If you prefer that we not provide your information to our business partners, you may "opt-out" from receiving information about third party products and services at the time of registering for the free trial offer or by sending an email from the email address assigned to your TimeMaker account to remove@timemaker.org.  Upon receipt of an “opt out” election or email, TimeMaker will no longer provide your information to selected business partners.
 
Change of Information
You have the right to access, correct, update, and/or delete your personal information at any time. You can do so by logging into the Web site with your username and password.  Changes to your information are typically executed immediately. For example, if you delete your account, your account immediately becomes inaccessible and all your personal information within your account is completely removed from the TimeMaker Servers. 
 
Choice/Opt-out
You may ‘opt-out’ of receiving additional information from us or, if you are using TimeMaker pursuant to a free trial offer, from having us provide your personal information to our partners. You can make this election on any web page that requires personal information. 
 
If for any reason, the opportunity to make the ‘opt out’ election is not available on a web page that requires personal information, you can ‘opt out’ by sending an email from the email address assigned to your TimeMaker account to remove@timemaker.org.
 
If you do not wish to continue receiving information about TimeMaker software and other TimeMaker products, software upgrades, new products and services, new software features, software usage tips, newsletters, or other TimeMaker communications, you can opt-out of receiving these communications by replying to the unsubscribe in the subject line in the email.  This information will only be used to honor your opt-out request and not be shared with any third-party.
 
We make a sincere effort to respond to your requests to update or correct your personal information. If you believe that TimeMaker does not have your current personal information, you can update it at https://www.sales@timemaker.org.
 
Refer-A-Friend
If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address. We will automatically send your friend an email inviting him or her to visit the site.
 
BUSINESS INFORMATION AND DATA
A synchronized copy of your business information and other data (your “business information”) is maintained on TimeMaker’s servers unless you have chosen to operate your TimeMaker network utilizing your own server. 
 
When you use the TimeMaker server to host your network users, your business data is maintained on TimeMaker’s secure servers so you will be able to view your tasks, documents, contacts, calendar and other data by connecting to TimeMaker at any time.  This information is protected by secure socket layer (SSL) encryption AND WILL NOT BE SHARED WITH ANYONE and will be used solely to provide you with secure access to your data.  TimeMaker’s online access provides you the benefits of secure anywhere, anytime access to you data, automated backup and quick restore capabilities, as well as multi-system synchronization capabilities.
 
Upon termination of your service contract with TimeMaker, a copy of your business information may be made available to you in XML format if requested, subject to payment of an information copy fee. After delivery of the requested copy, or if no copy is desired, your business information will be permanently removed from TimeMaker’s servers although some residual copies may remain on our system.
 
MONITORING OF PRIVATE SERVER ACCOUNTS 
TimeMaker monitors the activity of private and public server accounts in order to collect statistical information such as cumulative counts of user logged-in time per day, number of users logged in each day, number of actions per day (completions, date changes, etc.), number of database transactions per day, etc.  This information is used to assist us in creating better products and services to meet your needs and will not be shared with any third party.
 
SECURITY INFORMATION
We have taken security measures, consistent with international information practices, to protect your personal and business information. These measures include technical and procedural steps to protect your data from misuse, unauthorized access or disclosure, loss, alteration, or destruction. Your information resides on a firewall-protected server that only selected TimeMaker personnel have access to via password.  TimeMaker strives to prevent unauthorized parties from viewing your information.  Your access to your information is protected by an encrypted password. We recommend that you do not disclose your password to anyone. If you forget your password, your TimeMaker administrator or TimeMaker’s online support can assist you with establishing a new password.
 
Although TimeMaker has taken reasonable precautions to prevent the inadvertent disclosure of your information, third parties may illegally intercept or access data transmissions from our servers as can be done from any server.  For this reason TimeMaker does not promise, and you should not expect, that private transmissions and communications will always remain private.
 
CHANGE OF OWNERSHIP
Notwithstanding anything to the contrary in this Privacy Policy, in the event TimeMaker goes through a business transition, such as a merger, acquisition or the sale of all or substantially all of its assets (a “Business Transition”), the TimeMaker servers containing your personal and business information will, in most instances, be part of the assets transferred. In such event, you will be notified via e-mail and/or through a notice on our Web site and any other appropriate methods prior to the Business Transition, and TimeMaker’s custody of your information will be transferred subject to all the terms and restrictions in this Privacy Policy.
 
Following a Business Transition, TimeMaker or its successors will continue to use your information in accordance with the Privacy Policy under which the information was collected.  You will retain ownership rights to your information and the ability to delete your information at any time. Please note, if you have deleted or deactivated your TimeMaker account or are an opt-out customer, then you will not be contacted in the event of a Business Transition. 
 
LINKS TO BUSINESS PARTNERS AND CO-BRANDED SITES
At the TimeMaker Web site, there may be a number of links to companies with whom we have a relationship. TimeMaker is not responsible for the privacy practices of our business partners. We encourage you to read their privacy statements, as they may differ from ours.
 
We may also link to co-branded Web sites that are maintained by TimeMaker and one or more of our business partners. When you submit information to one of our co-branded sites you may be submitting it to both TimeMaker and our business partners and the privacy policies of these co-branded sites may differ from this privacy policy. We encourage you to read the privacy policies on any co-branded site to which you link for information on the privacy practices of that site.
 
OTHER PRIVACY CONSIDERATIONS
Please remember that information you submit in a discussion group or forum will be deemed public information and is not confidential. There is a risk in such communication venues that information can be collected and used by others. Please be careful and responsible when you are online.
 
POLICY CHANGES
In the event there is a major change to TimeMaker’s privacy practices, a prominent notice will be posted on our Web site. If the change involves the use of your personally identifiable information, the notice will contain instructions on how you can opt-out of such use.
 
CHILDREN’S PRIVACY
TimeMaker is committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children’s online activities and interests. TimeMaker  software and our Web site are not intended for and may not be used by children under the age of 13. TimeMaker does not knowingly collect information from children under the age of 13 and TimeMaker does not target its Software or Web site to children under 13.
